Section 15 – Severability
If any provision of these Terms of Service is determined to be unlawful, void, invalid, or unenforceable, that provision shall still be enforceable to the fullest extent permitted by applicable law.
The unenforceable portion shall be deemed severed from these Terms of Service.
This shall not affect the validity and enforceability of any remaining provisions.
Section 16 – Termination
These Terms of Service remain effective unless and until terminated by either you or us.

If a satisfactory resolution is not reached, the dispute may be settled through binding arbitration in Sri Lanka, where applicable and legally permitted. The arbitrator’s decision shall be final and binding on all parties.

Shipping and delivery options, timelines, charges, and service areas may vary depending on your location, selected delivery method, product availability, courier service, payment method, order value, fraud checks, rewards redemption status, and operational conditions.
Delivery timelines provided on the Site are estimates only and are not guaranteed unless expressly stated.
We are not liable for delays caused by courier partners, weather, customs, public holidays, peak seasons, strikes, civil unrest, government restrictions, incorrect address information, customer unavailability, payment verification, fraud review, stock issues, system outages, or events outside our reasonable control.
You are responsible for providing accurate delivery information, including full name, address, phone number, email address, and any delivery instructions.
If delivery fails due to incorrect information, customer unavailability, refusal to accept delivery, unreachable contact details, blocked communications, or repeated failed attempts, additional charges may apply.
Risk passes to you upon delivery.
Where our Shipping Policy provides more specific terms, the Shipping Policy will apply to shipping, delivery, failed delivery, courier issues, and related matters.
Section 24 - Exchanges, Limited Returns, and Refunds
Exchanges, limited returns, and refunds are governed by our Exchange Policy.
Ceylon Elephant Co. is mainly an apparel and wearable products store. Due to hygiene, product condition, and quality assurance requirements, exchanges are allowed only under limited conditions and are subject to inspection and approval.
Exchange requests must be made within 48 hours of delivery through our Customer Care channels. Requests may be submitted by Call, WhatsApp, or email using the contact details provided on the Site or in these Terms.
To be eligible for exchange, the product must be in its original condition, unworn, unwashed, unused, undamaged, unaltered, and free from perfume, stains, odour, damage, or signs of use. All tags, labels, and packaging must be intact.
Items with removed, cut, detached, tampered, reattached, or altered tags are not eligible for exchange.
Only size or colour exchanges are permitted, subject to stock availability and approval under the Exchange Policy.
Each order is eligible for one exchange only. Repeated exchanges for the same order are not permitted.
Items purchased on sale, promotion, discount, or under other excluded offers may not be eligible for exchange unless expressly stated otherwise or required by applicable law.
Items that fail quality inspection will not be accepted for exchange.
Courier Pickup and Return Handling
Where a return pickup is arranged through our official courier partner, the customer must securely pack the item in its original inner and outer packaging.
Our official courier partner may contact the customer to arrange pickup after the exchange request has been accepted by Customer Care.
A delivery note or consignee note may be provided at pickup and may need to be shared with Customer Care.
Return pickup charges, delivery charges, re-delivery charges, and related courier charges may be payable by the customer unless Ceylon Elephant Co. confirms otherwise.

Where stated in the Exchange Policy or confirmed by Customer Care, the applicable pickup fee shall be payable by the customer at the time of collection. The current courier pickup fee is Rs. 500, unless updated by us or confirmed otherwise.
Exchange Via Store
Store exchanges are available only after Customer Care has reviewed the request and confirmed the eligible outlet and date.
Customers must contact Customer Care first with order details and clear images of the product for initial evaluation.
Once confirmation is provided by Customer Care, the customer may visit the pre-confirmed CECO or Spa Ceylon outlet on the pre-confirmed date.
The item will be inspected again at the outlet. If the item meets the exchange eligibility criteria, the exchange may be approved and completed at the store.
If the item does not meet the required criteria, the exchange will not be accepted.
Inspection and Approval
All returned items are subject to strict quality inspection.
If the item passes inspection, the exchange will be processed and delivered within the timeframe stated in the Exchange Policy, subject to stock availability and operational conditions. The current estimated processing and delivery timeframe for approved courier exchanges is 7 to 10 working days, unless updated by us or affected by operational conditions.
If the item fails inspection, it may be returned to the customer at the customer’s cost.
Refunds
Refunds may be provided only in limited cases, including where required by law, where an order cannot be fulfilled, where a product is unavailable after payment, where an approved product issue qualifies for refund, or where our Exchange Policy expressly allows a refund.
Refunds, where approved, will usually be processed through the original payment method where possible.
Refund processing times may vary depending on payment gateway, bank, card issuer, wallet provider, Shopify, courier partner, or other third-party service provider.
Shipping charges, Cash on Delivery charges, courier pickup charges, re-delivery charges, payment processing charges, gift wrapping charges, donation-related amounts, redeemed rewards, expired vouchers, and other fees may be non-refundable unless required by law or stated otherwise in our Exchange Policy.
Where an order was paid using rewards, points, vouchers, discounts, or promotional benefits, the treatment of any exchange, store credit, refund, reversal, or replacement may vary depending on the relevant rewards or promotion terms.
Ceylon Elephant Co. reserves the right to refuse any exchange, return request, replacement, store credit, refund, or related request that does not meet the stated conditions in these Terms, the Exchange Policy, product-specific terms, campaign-specific terms, or applicable law.
Nothing in these Terms or the Exchange Policy is intended to exclude, restrict, or limit any rights you may have under applicable Sri Lankan consumer protection laws.
Section 25 – Intellectual Property
All content on the Site, including but not limited to text, images, photographs, graphics, product designs, garment prints, embroidery designs, artwork, logos, icons, videos, audio, brand names, collection names, campaign names, donation-linked materials, rewards-related materials, website design, layout, AI-assisted content, and other materials, belongs to or is licensed to Ceylon Elephant Co., JANET LANKA (PVT) LTD, or our licensors.
You may not copy, reproduce, modify, distribute, publish, display, sell, license, exploit, train AI models on, scrape, extract, or create derivative works from any Site content without our prior written permission.
No right, title, or interest in any intellectual property is transferred to you through your use of the Site or purchase of any product.
Unauthorized use of our intellectual property may result in legal action.
Section 26 – Conservation, Awareness, and Donation-Linked Communications

We do not guarantee that every purchase contributes to a donation, conservation project, or specific beneficiary unless expressly stated.
We reserve the right to update, change, correct, pause, replace, or discontinue conservation-related or donation-linked communications where necessary.
Section 27 – Force Majeure
We shall not be liable for any failure, delay, interruption, or inability to perform our obligations where such failure or delay is caused by events beyond our reasonable control.
This may include natural disasters, extreme weather, floods, fire, pandemics, epidemics, strikes, civil unrest, government action, import/export restrictions, logistics disruptions, payment gateway outages, cyber incidents, utility failures, Shopify downtime, cloud provider downtime, AI provider downtime, courier delays, supplier failures, data centre incidents, internet disruption, or other events outside our reasonable control.
Section 28 – Customer Responsibility
You are responsible for:
reading product descriptions before placing an order;
checking size guides and fit information;
reviewing product care instructions;
providing accurate account, billing, and delivery information;
checking order details before confirming payment;
ensuring someone is available to accept delivery;
maintaining access to your email, phone, WhatsApp, or other contact channels;
reviewing rewards, promotion, shipping, exchange, and donation-linked terms where applicable;
complying with these Terms and related policies;
contacting us promptly if there is an issue with your order;
following the Exchange Policy if requesting an exchange;
keeping products unused, unworn, unwashed, unaltered, and with all tags, labels, and packaging intact if an exchange may be requested.
Failure to meet these responsibilities may affect order fulfilment, delivery, exchange eligibility, limited return eligibility, refund processing, rewards eligibility, promotion eligibility, or customer support handling.
Section 29 – Consumer Rights
Nothing in these Terms is intended to exclude, restrict, or limit any rights you may have under applicable Sri Lankan consumer protection laws.

We may refuse, hold, cancel, refund, reverse, delay, or reject any order, reward, voucher, discount, promotion, refund, exchange, account activity, or customer benefit where we suspect fraud, abuse, unauthorized activity, resale activity, payment risk, chargeback risk, or violation of these Terms.
We are not obligated to disclose our fraud detection rules, risk scoring, internal decision logic, AI-based review methods, or security processes.
Section 35 – Relationship With Separate Policies

Section 36 – Final Terms
